WAIVER OF LIABILITY & ACKNOWLEDGEMENT OF RESPONSIBILITY OF GUESTS(Required)
By submitting this form, I understand that the activities provided by Brentwood Swim & Tennis Club, Inc. present the opportunity for risk of personal injury to myself and my family members while participating in these activities. b. I agree to indemnify and hold harmless the above mentioned organizations and/or individuals, their agents and/or employees, against any and all liability for personal injury, including injuries resulting in death to me, my child(ren) and/or other family members, or damage to my property, the property of my child(ren) and/or other family members, or both, while I (or my child(ren) or family members) use the facilities of Brentwood Swim & Tennis Club, Inc. I therefore freely and voluntarily execute this release with such knowledge, assume the risk of personal injury and/or property loss arising from or in any way connected with participation in any activities offered by Brentwood Swim & Tennis Club, Inc. c. I authorize and grant permission for a representative Brentwood Swim & Tennis Club, Inc. to treat minor injuries including scrapes, small cuts, splinters, and insect bites. d. I authorize and grant permission for a representative of Brentwood Swim & Tennis Club, Inc. to obtain emergency medical care from any licensed physician or hospital and/or medical clinic should my child become ill or injured while participating in educational activities away from home or at other times when neither parent nor guardian is available to grant authorization for emergency treatment. e. I grant permission and understand that photos and other images taken at the club could be used in social media. f. I understand that I am responsible for supervising my child(ren) who are unable to swim and must be within an arm’s length from them while they are in the pool, even if the child(ren) are wearing water wings, inflatable devices, or any other floatation devices. If I am unable to supervise my child(ren) who are unable to swim, I am responsible for assigning this responsibility to another adult in my family (spouse, grandparent) or babysitter or nanny older than age 16. 13. I hereby acknowledge that I have received, have read, understand and agree to the policies #1-#12 listed above applicable to this membership. I hereby agree that use of the Club and privileges under the membership are subject to the terms, conditions and restrictions set forth therein. I agree that I am the person who is responsible for the financial obligations related to this membership. By checking this box, you are agreeing to the waiver of liability, Acknowledgement of Guest Responsibility and the rental terms set forth in our rental agreement once your event is confirmed.

In consideration of being permitted to use the facilities at Brentwood Swim and Tennis Club, 1933 Harpeth River Dr., Brentwood, Tennessee (the “Club”), for an event on the date specified above, at which my invited guests will be present (“Guests”), the undersigned member of the Club (the “Member”), hereby executes this Waiver of Liability and Acknowledgement of Responsibility of Guests (“Waiver and Acknowledgement”).

The Member does hereby, voluntarily and without duress, execute this Waiver and
Acknowledgement under the following terms:

1. Waiver and Release. The Member does hereby waive, covenant not to sue, release and forever discharge, indemnify and hold harmless the Club from any and all liability, claims, fines, suits, orders, actions, damages, costs and/or expenses and demands of whatever kind or nature, either in law or in equity, that the Member or its Guests may have against the Club arising out of or in any way connected with or
related to the Member’s or the Guests’ presence at or participation in activities arising from my utilization of the Club. The Member understands that this Waiver and Acknowledgement discharges the Club from any and
all liability or claims that the Member of the Guests may have against the Club with respect to any bodily injury, personal injury, illness, medical expenses, death, property damages or consequential expenses or losses that may result from the Member’s or the Guests’ utilization of the Club for the Event, whether caused by the negligence, the action or inaction of the Club

2. Assumption of the Risk. The Member is aware of and expressly and specifically assume all risks associated
with the Member’s and the Guests’ use of Club for the Event and participation in the activities at the Club during the Event.

3. Acknowledgement of Responsibility for Guests. The Member understands, acknowledges and agrees that:
(i) the Member is responsible for the conduct of the Guests while at the Club for the Event,
(ii) if the conduct,
manner or behavior of any Guest at the Event is deemed to be unsatisfactory by the Club, the Member will cause such Guest to leave the Club property, or alternatively, the Club may require the Guest to leave the Club
property, and
(iii) the Member is liable for any property damage and/or personal injury at the Club, caused by the Member or the Guests at the Event.

4. Other. The Member expressly agrees that this Waiver and Acknowledgement is intended to be as broad and inclusive as permitted by the laws of the State of Tennessee, and that this Waiver and Acknowledgement shall be governed by and interpreted in accordance with the laws of the State of Tennessee. The Member agrees
that in the event any clause or provision of this Waiver and Acknowledgement shall be held to be invalid by any court of competent jurisdiction, the invalidity of such clause or provision shall not otherwise affect the
remaining provisions of this Waiver and Acknowledgement which shall continue to be enforceable.

5. Execution. The Member executes this Waiver and Acknowledgement for full, adequate and complete consideration fully intending to be bound by same. If there are multiple Members under the same account number listed below, I represent that I am duly authorized to execute this Waiver and Acknowledgement on behalf of all the Members under the Member Number listed below.

Payment Terms(Required)

Brentwood Swim & Tennis will provide you with an estimate of costs for your event based on the event space your party will be using, and the rental costs according to our "Event Space Rental Options & Pricing" document. The final costs of your event will be calculated at the close of your event and any additional fees incurred will be relayed to you by a BSTC representative or your event manager. BSTC may or may not choose to collect a deposit prior to the day of your event. You can expect to be billed the full amount for your event (or remainder if a deposit is collected) on your next month's billing cycle (after the month of the event) for your membership account.
DECORATIONS: Any adhesive used to mount any decor must be approved by the Club Manager. In the event that any damage is done to the club property or building, we will notify you immediately after your event. We will provide an estimate of the damage to the property incurred during the event and bill you accordingly.
